Description

The objective of this presentation is to describe the legal, policy and organisational issues around the full implementation of the pay-for-use model, and to present some of the possible ways of addressing them. These issues have been brought up by the members of this task force in previous discussions, and can be summarised into two main topics: 1.) restrictions on selling capacity paid by public funds and 2.) taxation issues. Other secondary issues arise when the customer is a public institution and public procurement rules apply, and they miss a culture of being invoiced on a per time-unit basis, instead of fixed capital costs. The internal reluctance to start offering services on a pay-per-use basis should be considered to ensure a successful implementation. In any case, the involvements of legal experts and tax advisors is most probably needed and encouraged.
